You can apply for Divorce 12 months and 1 day after you separated. Your separation date is when one person communicated to the other that the relationship was over. You might have kept living in the same house, as many people do for practical or financial reasons, but your separation date remains the same.

Although, if you kept living together and apply for Divorce less than 12 months after you started living in different residences, you must file extra paperwork (like an Affidavit from you and a friend/family member) declaring that you were actually separated despite living together. If you don’t like unnecessary paperwork, apply at least 12 months after you lived in different homes.

If you reconciled your relationship for less than 3 months, then extend your 12-month separation period by the same amount. If you reconciled for more than 3 months, then your 12-month separation period starts all over again.
