deceased estates

Amelia Leyden – Accredited Specialist in Family Law

When a person passes away, their assets and debts become their ‘estate’. This estate is often passed to loved ones through a Will or by intestacy laws (if they pass away without a valid Will).

Probate is a certificate from the Supreme Court which authorises a person (called an Executor) to handle the estate. Letters of Administration is basically the equivalent of Probate but where there is no valid Will. We can help you obtain Probate/Letters of Administration, collect the assets, calculate inheritance payments and distribute the estate. You might need Probate if the deceased had real estate, an aged care bond, bank accounts over a certain dollar amount, superannuation or other assets of value.
