Secret recording are a minefield. Get legal advice before making a recording one and certainly before disclosing it.

Sometimes, people take secret audio or video recordings of their (ex) partner without the other person knowing. Be weary that recording someone without their consent can be a criminal offence and get you into hot water. Producing it as part of a Court case could backfire.

If a recording is illegal, it if often not admissible in a Family Law Court case. However, there are limited exemptions where it is allowed. For example, some behaviour happens ‘behind closed doors’ when there are no other witnesses around and the evidence can be fundamental to a case and to the safety of a parent or child. Even then, there’s no guarantee the recording will be permitted or legal. There are legal protections available (but not to everyone) so you don’t face criminal charges for making the recording in the first place.
