When couples separate, what happens to their beloved fur-babies? In 2025, the Family Law Act changed and now allows pets to be part of an asset split. Pets are not “children” (I know, I know, controversial), so Parenting Orders cannot state who the pet will live with or set up a parenting timetable. But the pets are “property”, so Property Orders can say who will own it. Things a Court might look are include:

  • Who is the pet registered to?
  • Who paid for it?
  • Who has looked after it during the relationship?
  • Who has attended and paid for vet bills?
  • Is there an adult or child who has a close bond with the pet?
  • Is your new accommodation suitable for animals?
  • Can you care for a pet with your current work schedule?
  • Are there any safety risks or history of negligence, animal cruelty or family violence?
